Terms and Conditions

Acceptance of Terms 

By downloading, installing, and using our application (i.e. the App), you confirm that you are at least 13 years old (or such minimum age in your jurisdiction), have the legal capacity to enter, and agree to the Terms and Conditions stated below. If you are not of minimum age in your jurisdiction, do not have the legal capacity or do not agree with EVERY individual part of the Terms and Conditions, you must cease and desist from using our app and uninstall it immediately.  

Wes Hal, Folde LLC has the right to modify these terms and conditions at its discretion. Your continued use of the app after any posted modifications constitutes an agreement to abide and accept the updated terms and conditions. 

Definitions 

  • “App”: means the “Label Guard” application (or any future apps) licensed and made available on Google Play by Wes Hal, Folde LLC. 

  • “Company”: means Wes Hal, Folde LLC, the app’s developer and owner. 

  • “User”: implies you or any person who downloads, installs, and/or uses the app. 

  • “Content”: refers to all the graphics, images, text, ratings, scores, and data provided by the App.  

  • “AI Model”: refers to the artificial intelligence (AI) system (i.e., Google Gemini AI models) used to analyze product contents for human, plants, animals, and environmental health and safety risk ratings and assessments. 

  • “Analysis”: means the app’s ability to scan QR codes, barcodes, and take photos of labels, extract their text contents for AI model analysis for human, plants, animals, and environmental health and safety risk ratings and assessments. As well, receiving typed or paste input text for the same purpose. 

Description of Service 

Label Guard App: This app allows users to scan QR codes and barcodes, take photos of labels, and type or paste text content. This enables the AI model to extract their text contents and analyze and provide summarized health and safety risk ratings of "safe" when there is little concern at typical exposure, “moderate” when the risk is increases due to chronic/long-term exposure, and “risky” when short-term/acute harm is immediately possible such as for highly regulated or hazardous toxins. Summaries of the assessment of the impacts on humans, plants, animals, and environmental are also provided, along with a final conclusion. The app’s AI model verifies its findings with creditable sources such as the EPA, ECHA, WHO, FDA, and more. 

Accurate Usage and Prohibited Conduct 

The user agrees to use the App as intended and stated in the “Description of Service” section of Terms and Conditions. The user agrees to NOT reverse-engineer, decompile, or tamper with the App or its AI Model. The user agrees to NOT use the App for any unauthorized commercial purpose. 

License Grant and Limits 

Based on the terms, Wes Hal, Folde LLC grants the user a non-exclusive and revocable license to download, install, and use the App on the user’s device. The user is forbidden from sublicensing, renting, selling, distributing, or producing derivative software and applications based on the App or its code. The user is forbidden from obstructing or causing damage to the App’s functionality, its data, or AI model. 

Intellectual Property 

Intellectual Property (IP) includes, and is not limited to, all software source and object code, software components, backend services, APIs, AI system prompts and instructions, build files, databases, models, and all current and future mobile and web app versions. As well, all documentation, technical materials, copyrightable works (registered or unregistered), trade secrets, confidential information, know-how, and branding. All rights, title, and interest in the App(s) IP remain with Wes Hal, Folde LLC and our licensors. The App is protected by copyright, trademark, and other intellectual property laws. 

Governing Law 

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. 

Privacy Policy 

The App’s users are governed by Wes Hal Folde’s Privacy Policy, which explains how we collect, use, and disclose information. By using the App, you consent to that data handling. 

User Content 

By uploading images, data, or other content, you grant the Company a limited, non-exclusive license to process such content solely for the purpose of providing the App’s functionality. Images and data are analyzed automatically and are not used for advertising or resale. 

Disclaimer and Liability 

1. FOR INFORMATIONAL PURPOSES ONLY 

The content provided by "the App" is for informational and educational purposes only. It is not intended to be a substitute for legal, professional, or medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or dietary restriction. 

2. NOT A MEDICAL DEVICE 

This App is NOT a diagnostic tool. Do not rely on this App to make life-threatening health decisions, such as determining if food is safe for severe allergies (e.g., peanuts, shellfish). The App’s content provides informational and analytical content only.  It does not constitute medical, nutritional, legal, professional, or regulatory advice. Users must NOT rely on the Application as a substitute for professional advice, diagnosis, or treatment. Always consult qualified professionals before making health, dietary, or safety decisions. 

3. AI & ACCURACY LIMITATIONS 

This App uses automated Artificial Intelligence (AI)-based systems such as Google Gemini that utilize Optical Character Recognition (OCR) to analyze images and interpret text. 

The AI model still has a risk of error from misinterpreting or missing text or data entirely due to poor lighting, wrinkled labels, or blurry photos, for example. Thus, there is a probability that AI delivers incorrect risk assessments that are incomplete, inaccurate, outdated, or incorrect. Thus, a product’s risk rating (Safe, Moderate, Risky) by the App could still have harmful content. The App’s outputs may not be complete, current, or error-free. The Company does not guarantee accuracy, completeness, or reliability of results. Lastly, product formulations change, and data retrieved from third-party databases may be outdated. You must always verify the physical label on the product and its contents before consumption. 

 4. LIMITATION OF LIABILITY 

To the maximum extent permitted by law, the Company and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from use or reliance on the App and the information it provides regardless of its accuracy in analysis.  This includes but is not limited to health decisions that may lead to allergic reactions, illnesses, or other complications, financial loss, or regulatory reliance. 

5. "AS IS" BASIS 

The App is provided on an "AS IS" and "AS AVAILABLE" basis. The developer makes no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or completeness of the App's content. 

Indemnification 

You agree to indemnify, defend, and hold harmless Wes Hal, Folde LLC and its affiliates from any claim, demand, liability, damage, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the App. 

Termination 

We may suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, all rights granted to you under these Terms will immediately cease.
