 Summary 

This Privacy Policy specifies how Wes Hal, Folde LLC (the “company”) collects, uses, discloses, and protects information obtained through our software applications (e.g., Label Guard) available on Google Play. This privacy policy addresses privacy considerations and concerns for all users. Its contents comply with the European Union’s General Data Protection Regulation (GDPR). 

Definitions 

  • “App”: means the “Label Guard” application (or any future apps) licensed and made available on Google Play by Wes Hal, Folde LLC. 

  • “Company”: means Wes Hal, Folde LLC, the app’s developer and owner. 

  • “User”: implies you or any person who downloads, installs, and/or uses the app. 

  • “Content”: refers to all the graphics, images, text, ratings, scores, and data provided by the App.  

  • “AI Model”: refers to the artificial intelligence (AI) system (i.e., Google Gemini AI models) used to analyze product contents for human, plants, animals, and environmental health and safety risk ratings and assessments. 

  • “Analysis”: means the app’s ability to scan QR codes, barcodes, and take photos of labels, extract their text contents for AI model analysis for human, plants, animals, and environmental health and safety risk ratings and assessments. As well, receiving typed or paste input text for the same purpose. 

Data Controller   

The Company is the data controller responsible for the processing of data under this Privacy Policy, in accordance with Article 4(7) of the General Data Protection Regulation (GDPR). 

Data and Information Collection   

We do not collect any personal information directly from you. This includes your name, email address, or phone number. Information we may collect includes:  

1. images, QR codes, bar codes, and text uploaded by the users for analysis. Additionally, all text, data, and other information collected from these uploads (e.g., ingredients, contents, labels, products),  

2. technical data (device type, operating system, IP address (anonymized), language preference, app version, error logs), 

3. anonymous usage of analytics, and 

4. usage data is automatically collected to understand how users interact with the App (e.g., session duration, screens viewed, and clicks). 

Children’s Privacy  

The App is not intended for children under the age of 13 (or 16 in the EU). The Company does not knowingly collect personal data from children. 

Purpose for Collection   

We process data solely to analyze products, generate automated risk and informational summaries, improve application stability and performance, and to comply with legal obligations. 

Artificial Intelligence (AI) Processing  

Data and information (e.g., images, text, and scans) uploaded to the App are processed automatically and temporarily using the artificial intelligence (AI) model for analysis purposes only. This data and information are not used to identify individuals or sold or used for advertising. However, the data and information uploaded to the App may temporarily be stored for processing should short-term retention be required for system security, error diagnosis, or legal compliance. Furthermore, the App does not perform facial recognition, biometric identification, or profiling of individuals. Images are analyzed solely for product and label content. 

Legal Basis 

The company processes personal data under the following legal bases: 

- User consent 

- Performance of a service requested by the user 

- Legitimate interest in operating and improving the Application 

Data Retention and Sharing  

Data is retained only as long as necessary to provide the service or comply with legal obligations. Users may request deletion of their data at any time. The Company does not sell personal data. The Company may share data with trusted service providers (e.g., cloud infrastructure, AI services) strictly for application functionality, under confidentiality and data protection obligations. Data may be processed in the United States or other jurisdictions with appropriate safeguards in place. 

User Rights 

Users have the right to:

- Withdraw consent 

- Lodge a complaint with a data protection authority

The Company may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated effective date.
